sparc.fun Terms of Service & General Contest Rules

The following document is sparc's Terms of Service Agreement & General Contest Rules. This is a legal contract between you and PayPer Technologies Inc. d/b/a sparc (“sparc”). Please read the entire agreement carefully before accessing or using the sparc.fun website (the “Website”), sparc Services (“Services”), sparc Software (“Software”), Partner Sites, affiliate sites (or any information, products, software, services or other features). Note many of the capitalized terms in the foregoing sentences are defined in sparc’s separate privacy policy.  Those definitions also are incorporated into and apply in this agreement.  sparc’s privacy policy details how user data is used by sparc.

sparc will provide its services to you only upon your acceptance of this Agreement. By accessing and browsing the site or utilizing the sparc software, you accept, without qualification or limitation, these Terms of Service & General Contest rules (the "Agreement") as well as sparc’s privacy policy and acknowledge that any other agreements that may exist between you and sparc with respect to the following terms and conditions are superseded and of no force and effect.

Section 21, towards the end of this Agreement, describes how sparc.fun treats cheating.

Section 22, at the end of this Agreement, provides general contest rules. 

ACCEPTANCE OF TERMS.  

The sparc Website and Software are owned by sparc.

sparc reserves the right to amend and update the Agreement at any time without notice to you. The most current version of the Agreement can be found and reviewed www.sparc.fun/terms. EACH TIME THAT YOU ACCESS OR USE THE sparc.fun WEBSITE OR SOFTWARE OR SERVICES, YOU REAFFIRM YOUR CONSENT TO THE THEN-EXISTING TERMS OF USE AND THEN-EXISTING PRIVACY POLICY. 

(1) USE & ELIGIBILITY REQUIREMENTS.  By visiting the sparc Website or using the sparc Software or Services, you consent to the following conditions. sparc may, at its discretion, terminate your account, deny you eligibility to prizes, or deny you access to the sparc.fun domain name via blocking if it feels you have at any time violated the following eligibility requirements: 

1. You must be at least 13 years of age to access the website or to use sparc’s Software of Services.  The United States’ Children's Online Privacy Protection Act ("COPPA") requires that we inform parents and legal guardians about how we collect, use, and disclose personal information from children under 13 years of age. sparc does NOT allow users under 13 years of age to register for an account or use the sparc.fun Website or Software or Services.  

2. sparc content is not guaranteed for accuracy or completeness. This applies to our publicly available content AND our trivia question products: sparc aims to be as accurate as possible when it comes to presenting accurate trivia questions and quiz content. However, sparc does not warrant that any trivia content is accurate, complete, reliable, current, or error-free. In most instances, trivia content on sparc.fun has been sourced from individuals or repositories that are outside the control of sparc, and has not been verified or thoroughly researched, and inaccuracies may very well exist. sparc.fun is NOT a researched encyclopedia.
   
   It is ultimately your responsibility to check and validate any content originating from sparc.fun. We provide our content for entertainment purposes only. sparc is not responsible for the accuracy of trivia questions and is not responsible for problems that may arise from the use of incorrect or incomplete trivia questions, either on the sparc.fun website or used externally, whether used under license or otherwise.  One account per person. You may not create or play under more than one sparc account.  Players found to be using more than one account will have all accounts closed.

3. You agree not to attempt to reverse engineer, breach security measures of or otherwise access sparc for reasons other than standard game play. 

4. sparc content (text and images) are copyrighted under Canadian and international law law, you therefore agree not to electronically copy or redistribute any content gained from sparc absent express prior written approval from sparc. 

5. You may not use any data mining, automated scripts, bots, information gathering or other automated mechanisms while connected to the sparc Website, Software, or Services. 

6. You may not use sparc in any way to promote a website, product or service.

7. You may not share any content or answers found within sparc games with other users to achieve an unfair advantage. You must not use flaws or holes in the system to gain unfair advantages in games or quizzes. Anything considered cheating is prohibited. 

8. You agree to receive email updates from sparc. This may include an introductory "Welcome" email, and other emails that the system may send as a result of you playing games on the site. These secondary emails may be opted out of on an individual basis. We also retain the right to email you periodically with updates about our site and your account.

9. You agree to and understand that sparc uses IP address logging and may use certain 3rd parties to verify your compliance to these terms.

10. You agree that sparc may terminate your account at any time without notice for any reason at its sole discretion. 

11. You understand that sparc player scores and awards will not be "reimbursed" or "undone" due to system bugs, network errors, personal computer issues, or any other reasons.

12. You agree to respect and abide by rules and directions laid out by any sparc representative including but not limited to any contest editor or moderator. Such individuals may moderate/delete content or terminate your account at any time for any reason.

13. You have read and understand the content of our privacy policy. You understand that there are inherent risks in submitting information to websites, and in what you disclose publicly about yourself.

(2) SERVICES.  sparc does not guarantee continuous, uninterrupted or secure access to sparc services. The operation of the sparc Website, Services, or Software may be interfered with by numerous factors both inside and outside of sparc's control, and some interruption of services may occur. sparc currently or in the future, directly or through Partner Sites, may provide you with access to a variety of resources, including trivia gaming, personal trivia tournaments, subscription services, images and information posted by sparc, product information, communication forums, chat rooms, and other services (collectively our "Services"). The Services, including any updates, enhancements, new features, and/or the addition of any new Web properties or Services, are subject to the Agreement. Some of the Services are available for use without sparc by the general public, and other of the Services may now or in the future be limited to use by users. 

(3) USE LIMITATION.  Unless otherwise specified, the Services, Software, and Website are for your personal use, and may not be used for commercial purposes except as provided in this Agreement.

1. You may not reproduce, alter, modify, copy, distribute, transmit, display, perform, publish, license, create derivative works from, transfer, or sell any information, images, software, products or services obtained from the Services.

2. You may direct others to the sparc Website, Services, or Software to view information or images. 

3. sparc is made available solely for use according to these terms of use.

4. Any reproduction or redistribution of sparc properties not in accordance with these terms of use is expressly prohibited by law, and may result in severe civil and criminal penalties.

Violators of sparc's copyright will be prosecuted to the fullest extent of the law.

Any use of the sparc Website, Services, or Software in violation of the Agreement by any person may subject such person to loss of use of the sparc Website, Services, or Software. 

WITHOUT LIMITING THE FOREGOING, COPYING OR REPRODUCTION OF THE SOFTWARE TO ANY OTHER MEDIA, OR COPYING OR REPRODUCTION OF THE SOFTWARE TO ANY SERVER OR LOCATION FOR FURTHER REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY PROHIBITED, UNLESS SUCH REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY PERMITTED BY THE LICENSE AGREEMENT ACCOMPANYING SUCH SOFTWARE.  THE SOFTWARE IS WARRANTED, IF AT ALL, ONLY ACCORDING TO THE TERMS OF THE LICENSE AGREEMENT. EXCEPT AS WARRANTED IN THE LICENSE AGREEMENT, SPARC HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE SOFTWARE, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, AND INCLUDING ALL WARRANTIES AND CONDITIONS OF FITNESS FOR A PARTICULAR PURPOSE, AND INCLUDING ALL WARRANTIES OF TITLE, AND INCLUDING ALL WARRANTIES OF NON-INFRINGEMENT.  SPARC MAY MAKE AVAILABLE AS PART OF THE SERVICES OR IN ITS SOFTWARE PRODUCTS, TOOLS AND UTILITIES FOR USE AND/OR DOWNLOAD. SUCH TOOLS AND UTILITIES ARE PROVIDED FOR YOUR CONVENIENCE ONLY, AND SPARC DOES NOT MAKE ANY ASSURANCES WITH REGARD TO THE ACCURACY OF THE RESULTS OR OUTPUT FROM USE OF SUCH TOOLS AND UTILITIES. YOU ARE RESPONSIBLE FOR ANY FAILURE BY YOU TO RESPECT THE INTELLECTUAL PROPERTY RIGHTS OF OTHERS WHEN USING THE TOOLS AND UTILITIES MADE AVAILABLE THROUGH THE SERVICES OR IN SPARC SOFTWARE PRODUCTS. 

(4) UNLAWFUL OR PROHIBITED USE.  You agree that you will not use the Website, Software, or Services for any purpose that is unlawful or prohibited by the Agreement, and you agree that it shall be a condition of your use of the Website, Software, and Services that you comply with the Agreement. You may not use the Website, Software, or Services in any manner that could damage, disable, overburden, impair or deny Website, Software, or Services to any sparc server, or the network(s) connected to any sparc server, or interfere with any other user's use and enjoyment of the Website, Software, or Services. You may not attempt to gain unauthorized access to any Website, Software, or Services including other accounts or Personal Information of any other user, computer systems or networks connected to any sparc server or to any of the Website, Software, or Services, through hacking, cracking, password mining or any other means. You may not obtain or attempt to obtain any materials, images, or information through any means not intentionally made available through the Website, Software, or Services.  You may not use any emailing feature to spam another user of the Website, Software, or Services or Partner Site.

Individuals who have been banned do NOT have permission to access our servers. Such individuals may be in breach of computer crime laws.

(5) NOTICE ON PERSONAL USE OF DOCUMENTS AVAILABLE ON THIS WEBSITE.  Permission to use documents (such as readme text files, help files, press releases, e-mails to users of the Website, Software, or Services and FAQs, information and images posted by other users, but excluding design or layout of the sparc Website, Services, or Software or any other sparc owned, operated, licensed or controlled Website) (“Documents”) from the Services is granted, provided that

1. the copyright notice and the sparc Website URL appears in all copies and that both the copyright notice and this permission notice appear,

2. use of such Documents from the Services is for informational and non-commercial or personal use only and will not be copied or posted on any website, network computer or broadcast in any media, and

3. no modifications of any Documents are made. Use for any other purpose is expressly prohibited by law, and may result in severe civil and criminal penalties.

Violators will be prosecuted to the maximum extent possible.  Permission to use Documents specified above does not include the design or layout of the sparc Website, Services, or Software or any other sparc owned, operated, licensed or controlled Website. Elements of the sparc Website, Services, or Software are protected by trade dress, trademark, unfair competition, and other laws and may not be copied or imitated in whole or in part. No logo, graphic, sound or image from any sparc website may be copied or retransmitted unless expressly permitted by sparc. 

SPARC AND/OR ITS RESPECTIVE SUPPLIERS AND/OR PARTNER SITES MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY OF THE INFORMATION CONTAINED IN THE DOCUMENTS, OR IN IMAGES OR INFORMATION POSTED BY USERS, OR RELATED GRAPHICS PUBLISHED AS PART OF THE SERVICES FOR ANY PURPOSE. ALL SUCH DOCUMENTS, IMAGES, INFORMATION, AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. SPARC AND/OR ITS RESPECTIVE SUPPLIERS AND/OR PARTNER SITES HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, INCLUDING ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, WHETHER EXPRESS, IMPLIED OR STATUTORY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. IN NO EVENT SHALL SPARC AND/OR ITS RESPECTIVE SUPPLIERS AND/OR ITS PARTNERS SITES BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR ACCURACY OF INFORMATION AVAILABLE FROM THE SERVICES. YOU ARE RESPONSIBLE FOR INDEPENDENTLY VERIFYING ALL INFORMATION AVAILABLE FROM THE SERVICES, AND YOU AGREE TO USE THE INFORMATION AVAILABLE FROM THE SERVICES AT YOUR OWN RISK.  THE DOCUMENTS AND RELATED GRAPHICS PUBLISHED ON THE WEBSITE, SOFTWARE, OR SERVICES COULD INCLUDE TECHNICAL INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. SPARC AND/OR ITS RESPECTIVE SUPPLIERS AND/OR PARTNER SITES MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE PRODUCT(S) AND/OR THE PROGRAM(S) DESCRIBED HEREIN AT ANY TIME. SPARC DOES NOT HOLD ITSELF OUT AS A ''CENSOR'' OR ''MONITOR'' AND DOES NOT MONITOR THE CONTENT OF INFORMATION, DATA, OR IMAGES UPLOADED BY USERS OR WHICH MAY BE POSTED TO THE SPARC WEBSITE, SOFTWARE, OR SERVICES OR DATABASE (INCLUDING ANY CHAT ROOMS OR BULLETIN BOARDS WHICH MAY IN THE FUTURE BE ESTABLISHED ON THE SPARC WEBSITE, SOFTWARE, OR SERVICES) BY USERS OR THE GENERAL PUBLIC. SPARC DISCLAIMS ALL RESPONSIBILITY FOR ANY MATERIAL UPLOADED TO OR POSTED ON THE SPARC WEBSITE, SOFTWARE, OR SERVICES OR DISCUSSED OR POSTED ON SUCH CHAT ROOM OR BULLETIN BOARD, AND YOU ARE RESPONSIBLE FOR INDEPENDENT VERIFICATION OF THE ACCURACY OF SUCH MATERIAL. 

(6) NOTICES REGARDING SOFTWARE, DOCUMENTS AND SERVICES AVAILABLE ON THIS WEBSITE.  IN NO EVENT SHALL SPARC AND/OR ITS RESPECTIVE SUPPLIERS AND/OR PARTNER SITES BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, LOSS OF DATA OR LOSS OF PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THIS WEBSITE, SPARC SOFTWARE, SPARC SERVICES OR ANY DOCUMENTS OR MATERIALS POSTED TO THIS WEBSITE, OR PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR INFORMATION AVAILABLE FROM THE SERVICES. 

(7) RIGHT TO MODIFY OR DISCONTINUE THE WEBSITE, SOFTWARE, OR SERVICES.  sparc may discontinue, edit, delete or change any aspect of the Website, Software, or Services including, but not limited to: (i) restricting availability times, (ii) restricting compatibility with certain computer software or hardware, (iii) restricting amounts of use permitted, (iv) removing or changing content, features, or material available on the Website, and (v) restricting, suspending or terminating any user's privilege to use the Website, at sparc's sole discretion, and without prior notice or liability. 

(8) USER ACCOUNT SECURITY RESPONSIBILITIES.  If any of the Services requires you to sign up, you must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form, and by so doing you open an account with sparc. In opening an account, you also will choose or be assigned a password and a user name. You are solely and exclusively responsible for maintaining the confidentiality of your password and username, and you are solely and exclusively responsible for any and all activities that occur under your account or through access gained by use of your password and username. You agree to notify sparc immediately of any unauthorized use of your account or any other breach of security. sparc will not be liable for any loss that you may incur as a result of someone else using your password or account or gaining access to personal information you submit to the website, either with or without your knowledge. However, you could be held liable for losses incurred by sparc or another party due to someone else using your account or password. You may not use anyone else's account at any time, without the permission of the account holder. 

(9) CONTENT CONTRIBUTION AND COMMUNICATIONS.  The Website, Software, or Services may include email services, the creation of trivia quizzes, bulletin board services, chat areas, and/or other message or communication facilities designed to enable you to communicate with others (each a form of "Content Contribution" or "Communication" ). You agree to use the Website, Software, and Services only to post, send and receive messages and material that are proper and, when applicable, related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using the Website, Software, Services or the Communication Services, you will not submit, upload, send or post: 

• Software or executable programs of any kind; 

• Material protected by intellectual property laws (or by rights of privacy or publicity), including, by way of example, and not as limitation, copyright, patent, or trademark laws unless you own or control the rights thereto or have received all necessary consent to do the same by such other parties; 

• Material or statements which contain vulgar, obscene, or indecent statements or graphical images; 

• Defamatory or abusive statements. This includes accusations levelled against other players of cheating; 

• Statements which threaten the person or property of others; 

• Advertising or other forms of solicitation, including but not limited to offers to buy or sell, surveys, contests, pyramid schemes, chain letters, junk email, spamming or any duplicative or unsolicited messages (commercial or otherwise); 

• Statements that are insulting, bigoted, hateful, racially offensive, disrespectful of any ethnic group, any religion or religious group, disrespectful of any nationality, nation, or region of origin, disrespectful of any gender or sexual orientation, or which endorse or advocate illegal or immoral activity; 

• Statements or material which harasses, stalks, threatens or otherwise violates the legal rights (such as rights of privacy and publicity) of others;

• Statements about any other subscriber or the employees of any user; 

• Statements about sparc or any employee or volunteer of sparc or any Partner Site of sparc; 

• Material or statements that are inaccurate, misleading, or fraudulent and that you will not: 

  • Use any material or information, including images or photographs, that are made available through the Website, Software, or Services in any manner that infringes any copyright, trademark, patent, trade secret, or other proprietary right of any party; 

  • Upload files that contain viruses, Trojan horses, worms, bots, time bombs, cancelbots, corrupted files, or any other similar software, programs, or files that may damage the operation of another's computer or property of another, or hinder the use of sparc Website, Software, or Services. 

  • Download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally reproduced, displayed, performed, and/or distributed in such manner. 

  • Falsify or delete any copyright management information, such as author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded. 

  • Restrict or inhibit any other user from using and enjoying the Communication Services. 

  • Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service. 

  • Harvest or otherwise collect information about others, including email addresses; 

  • Violate any applicable laws or regulations; 

  • Create a false identity for the purpose of misleading others;  

  • Use, download or otherwise copy, or provide (whether or not for a fee) to a person or entity any directory of users of the Website, Software, or Services or other user or usage information or any portion thereof. 

sparc has no obligation to monitor the Website, Software, Services or the Communication Services. However, sparc reserves the right to review materials uploaded to the sparc database or posted to any Communication Services and to remove any materials in its sole discretion.

sparc reserves the right to terminate your access to any or all of the Communication Services at any time, without notice, for any reason whatsoever. 

sparc takes absolutely no responsibility for any damages that may result to a user from the material that the user contributes on sparc, including message board posts and quiz content.

Always use caution when giving out any personally identifiable information about yourself or your family members in use of any Communication Services. sparc does not control or endorse the content, messages or information found in any Services or Communication Services and, therefore, sparc specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Services or Communication Services, and you agree that you waive any claims against sparc relating to same, and to the extent such waiver may be ineffective, you agree to release any claims against sparc relating to same.

Users of Services and Communications Services, including any moderators or administrators, are not authorized sparc representatives or agents, and their opinions or statements do not necessarily reflect those of sparc, and they are not authorized to bind sparc to any contract. 

Materials uploaded to the Communication Services may be subject to posted limitations on usage, reproduction and/or dissemination; you are responsible for adhering to such limitations if you download the materials.

(10) IMAGES ON SPARC. No image on the sparc.fun Website, Software, or Services may be copied or distributed for purposes other than personal use. Images may not be republished, retransmitted, or reproduced. Some users may be able to set "avatars" on message board posts and in their profiles, and these images may be located on a 3rd party server that sparc has no control over. sparc will remove links to any such copyrighted images on request; please contact legal@sparc.fun.

Some images on the sparc.fun website are used under a Creative Commons license.

(11) INFORMATIONAL CONTENT DISCLAIMER - MATERIALS PROVIDED TO SPARC OR POSTED AT ANY SPARC WEBSITE, SOFTWARE, OR SERVICES.  sparc does not claim responsibility for views, expressions, and content of materials that you or any other user may provide, post, upload, input or submit to sparc (including quizzes, feedback items, and suggestions) ("Submissions").

However, by posting, uploading, inputting, providing or submitting ("Posting") your Submission you are granting sparc, its affiliated companies, Partner Sites, and necessary sublicensees exclusive permission to use your Submission, permanently and without restriction, in connection with the operation of their Internet businesses (including, without limitation, all sparc Services), including, without limitation, the license rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, sell, translate and reformat your Submission; to publish your name or associated username/alias in connection with your Submission; and the right to sublicense such rights to any supplier of the Services. 

No compensation will be paid with respect to the use of your Submission, as provided herein.

sparc is under no obligation to post or use any Submission you may provide and sparc may remove any Submission at any time in its sole discretion. 

By Posting a Submission you warrant and represent that you own or otherwise control all of the rights to your Submission, including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions. 

In addition to the warranty and representation set forth above, by Posting a Submission you warrant and represent that

1. you are the copyright owner of Posted content, or that the copyright owner of such content has granted you permission to use such content and/or images contained in such submission consistent with the manner and purpose of your use and as otherwise permitted by this Agreement,

2. you have the rights necessary to grant the licenses and sublicenses described in this Agreement, and

3. that any person or product owner depicted in such submissions, if any, has provided consent to the use of their likeness as set forth in this Agreement, including, by way of example, and not as a limitation, the distribution, public display and reproduction of such content.

By Posting any image, you are granting (a) to all users (for each such image available to users), and/or (b) to the general public (for each such image available anywhere on the Website, Software, or Services, other than portions of the Website, Software, or Services restricted to users), permission to use your image in connection with the use, as permitted by this Agreement, of any of the Website, Software, or Services, (including, by way of example, and not as a limitation, making prints and gift items which include such image), and including, without limitation, a non-exclusive, world-wide, royalty-free license to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your image without having your name attached to such image, and the right to sublicense such rights to any Partner Site r supplier of the Website, Software, or Services.

The licenses granted in the preceding sentences for your images will terminate at the time you completely remove such image from the Services, provided that such termination shall not affect any licenses granted in connection with such image prior to the time you completely remove such image. No compensation will be paid with respect to the use of your image or Posted content. 

SPARC DOES NOT HOLD ITSELF OUT AS A ''CENSOR'' OR ''MONITOR'' AND DOES NOT MONITOR THE CONTENT OF INFORMATION, DATA, OR IMAGES UPLOADED BY USERS OR THAT MAY BE POSTED TO THE SPARC WEBSITE OR DATABASE (INCLUDING ANY CHAT ROOMS OR BULLETIN BOARDS WHICH MAY IN THE FUTURE BE ESTABLISHED ON THE SPARC WEBSITE) BY USERS OR THE GENERAL PUBLIC. SPARC DISCLAIMS ALL RESPONSIBILITY FOR ANY MATERIAL UPLOADED TO OR POSTED ON THE SPARC WEBSITE, SOFTWARE, OR SERVICES OR DISCUSSED OR POSTED ON SUCH CHAT ROOM OR BULLETIN BOARD. 

(12) OTHER USERS & SOCIAL INTERACTIONS. sparc makes no guarantees about the veracity of information that other users may post about themselves either publicly or via private message. We do not verify ages, names, locations, or facts from other users. It is your responsibility to protect yourself when interacting with other users. sparc is not responsible for any claims arising from inter-personal interactions that you may have with other people as a result of meeting them on sparc.

sparc has absolutely no control or say in the interpersonal relationships that players form with one another. Sharing personal information with anyone, at any time, on any website, is a personal decision that lies entirely with the participants, and carries with it obvious risks.

(13) NOTICES AND PROCEDURE FOR MAKING CLAIMS OF COPYRIGHT INFRINGEMENT OR OFFENSIVE MATERIAL.  sparc takes infringement and plagiarism on its website seriously. If a user does post material for which you own the copyright to, we will gladly remove it from the sparc Website, Services, or Software upon request.

To expedite the Digital Millennium Copyright Act ("DMCA")'s copyright infringement process, we recommend that you simply report an act of infringement by contacting legal@sparc.fun, and we will investigate promptly, and further will promptly remove any offending material for which you show sufficient evidence of infringement.

If you desire the more formalized process, sparc processes, investigates, and responds to notifications of alleged infringement in accordance with the United States’ Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws. Upon receipt of notices complying or substantially complying with the DMCA, sparc will act expeditiously to remove or disable access to any material claimed to be infringing or claimed to be the subject of infringing activity and will act expeditiously to remove or disable access to any reference or link to material or activity that is claimed to be infringing. sparc will terminate access for any users who are repeat infringers. If sparc removes or disables access to any of the materials that are claimed to be infringing, sparc may attempt to contact the owner of such materials in order to give such owner an opportunity to respond to the notification, although sparc makes no promise to do so. Any and all counter notifications submitted by such owner will be furnished to the complaining party. sparc will give the complaining party an opportunity to seek judicial relief in accordance with the DMCA before sparc replaces or restores access to any material as a result of any counter notification.

sparc will respond to all other notifications of claimed infringement of intellectual property rights in accordance with applicable laws.

Pursuant to Title 17, United States Code, Section 512(c)(3), a notification of claimed infringement related to sparc must be a written communication addressed to the designated agent as set forth above, and must include substantially all of the following:

1. A physical or electronic signature of the owner (or person authorized to act on behalf of the owner) of an exclusive right that is allegedly infringed;

2. Specific identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a list of each copyrighted work claimed to have been infringed;

3. Information related to the work(s) reasonably sufficient for sparc to promptly locate the work (e.g. title of work, location within the Website, etc.);

4. Information reasonably sufficient to permit sparc to directly contact the complaining party, such as a complete name and address, telephone number, and an email address;

5. A statement that the complaining party has a good faith belief that use of the work(s) in the manner complained of is not authorized by the copyright owner, its agent, or the law;

6. A statement requesting that sparc take a specific act with respect to the alleged infringement (e.g., removal, access restriction or disablement); and

7. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

TRADEMARKS AND NAMES. Some sparc quizzes use the names of famous people, places, products, and large companies in trivia questions, and such trademarks may be mentioned in other Services, such as message boards. If you disapprove of a trademark's use on sparc.fun, or happen to be the subject of trivia questions (i.e. an actor, recording artist, etc) and wish trivia about you to be removed, please contact legal@sparc.fun.

INAPPROPRIATE CONTENT. We do our best to ensure that hateful, disrespectful, profane, or otherwise inappropriate material stays off sparc. In addition to basic profanity filters, some parts of the website are lightly moderated by volunteers. Still, there is always the possibility that such content will make its way onto our website. Please contact legal@sparc.fun so we can determine whether to remove the content and how to deal with any offending user expeditiously.

(14) HYPERLINK DISCLAIMER - LINKS TO THIRD PARTY SITES.  LINKS TO THIRD PARTY SITES WILL RESULT IN DEPARTURE FROM SPART SITE. THE SITES TO WHICH THE LINKS LEAD ARE NOT UNDER THE CONTROL OF SPARC AND SPARC IS NOT RESPONSIBLE FOR THE CONTENTS OF ANY LINKED SITE OR OF ANY SITE LINKED BY A LINK CONTAINED IN A LINKED SITE, OR FOR ANY CHANGES OR UPDATES TO SUCH SITES, OR REDIRECTION OF SUCH LINKS. SPARC IS NOT RESPONSIBLE FOR STREAMING OR WEB CASTING OR ANY OTHER FORM OF TRANSMISSION RECEIVED FROM ANY LINKED SITE. SPARC IS PROVIDING THESE LINKS TO YOU ONLY AS A CONVENIENCE, AND THE INCLUSION OF ANY LINK DOES NOT IMPLY ENDORSEMENT BY SPARC OF THE SITE TO WHICH THE LINK LEADS, OR OF ITS CONTENT. 

(15) UNSOLICITED IDEA SUBMISSION POLICY.  SPARC AND ITS EMPLOYEES DO NOT ACCEPT OR CONSIDER UNSOLICITED IDEAS, INCLUDING IDEAS FOR NEW ADVERTISING CAMPAIGNS, NEW PROMOTIONS, NEW PRODUCTS OR TECHNOLOGIES, PROCESSES, MATERIALS, MARKETING PLANS OR NEW PRODUCT NAMES. DO NOT SEND ANY ORIGINAL SOFTWARE CODE, IMAGES, IDEAS, BUSINESS PLANS, PRO FORMA'S, OR OTHER WORKS. THIS POLICY IS INTENDED TO AVOID MISUNDERSTANDINGS OR DISPUTES IF SPARC'S PRODUCTS OR MARKETING STRATEGIES APPEAR SIMILAR TO IDEAS SUBMITTED TO SPARC, THEREFORE DO NOT SEND YOUR UNSOLICITED IDEAS TO SPARC OR ANYONE AT SPARC. (17). INDEMNIFICATION: 

1. You agree to defend, indemnify, and hold harmless PayPer Technologies Inc. d/b/a sparc., and its owners, operators, officers, directors, employees, affiliates, assigns, agents, and Partner Sites from and against any and all actions, claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including without limitation attorneys' fees) arising from or in connection with: (i) your use of and access to the Website, Software, or Services; (ii) your violation of any term or provision of this Agreement; (iii) your failure to abide by applicable local, state, federal, and international law; (iv) your violation of any third party right, including without limitation any copyright, trademark, property, or privacy right; (v) any claim that one of your User Submissions caused damage to a third party; or (vi) any breach of any representation, warranty, or agreement made by you in this Agreement. This defense and indemnification obligation survives this Agreement and your use of the Website, Software, or Services.

2. To the fullest extent permitted under applicable law, you hereby release and waive any and all claims, liability, and causes of action against PayPer Technologies Inc. d/b/a sparc., and its owners, operators, officers, directors, employees, affiliates, assigns, agents, and Partner Sites  arising from or in connection with your use of the Website.

(18). LIMITATION OF LIABILITY: UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO NEGLIGENCE, SHALL SPARC, ITS OWNERS, OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, PARTNER SITES OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (1) USE OR INABILITY TO USE SPARC, INCLUDING WITHOUT LIMITATION USE OF OR RELIANCE ON INFORMATION AVAILABLE ON SPARC, INTERRUPTIONS, ERRORS, DEFECTS, MISTAKES, OMISSIONS, DELETIONS OF FILES, DELAYS IN OPERATION OR TRANSMISSION, NONDELIVERY OF INFORMATION, DISCLOSURE OF COMMUNICATIONS, OR ANY OTHER FAILURE OF PERFORMANCE; (2) ERRORS, MISTAKES, OPINIONS, OR INACCURACIES WITH REGARD TO INFORMATION AVAILABLE ON SPARC, (3) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE WEBSITE, (4) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (5) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE WEBSITE, (6) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR WEBSITE, SOFTWARE, OR SERVICES BY ANY THIRD PARTY, AND/OR (7) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE WEBSITE, SOFTWARE, OR SERVICES WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT SPARC ITS OWNERS, OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, PARTNER SITES OR AGENTS OR YOU, HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. YOU SPECIFICALLY ACKNOWLEDGE THAT SPARC SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

B. The Website, Software, and Services are controlled and offered by sparc from its facilities in Ontario, Canada. sparc makes no representations that the Website is appropriate or available for use in other locations. Those who access or use the Website from other jurisdictions do so at their own volition and are responsible for compliance with local law.

(19) NO AGENCY.  You and sparc are not engaged in any agency, partnership, joint venture, employee-employer, franchisee-franchisor or other type of relationship and no such relationship(s) are intended or created by this Agreement, and no such relationship(s) may be created by any use of the Website, Software, orServices by you, or by response by you to any information or statement of sparc which may appear on the sparc Website, Software, or Services, or by response by sparc to any material posted by you on the sparc Website, Software, or Services or by any failure of sparc to respond to any material posted by you on the sparc Website, Software, or Services or any other communications from you, and such relationship(s) may be created only by a written agreement signed by an authorized officer of sparc

(20) CHEATING.  sparc takes playing fair seriously. While the prizes offered through our trivia contests are generally valued at less than $500 CAD, and you can't really gain much from cheating, players who cheat do devalue the competitive spirit of our games and will be banned.  The following obligations also apply:

1. One Account Per Person: We allow a maximum of one account per person. Players using more than one account will have all of their accounts closed. We use a number of methods to track whether players are playing with more than one account or not, so please don't try to test us. You will eventually get caught and banned from our website.

2. Do Not Share Answers: Players may not share, distribute, copy/paste, or otherwise convey answer information to another player.

3. Players From the Same Household: If you are playing from the same household or on the same computer as someone else, please follow this basic guideline: you must play hourly and daily games at different times of the day. This will make it clear to us that you are indeed two different people. If you play the same games at the same time one after another, you risk being considered "one person" and receiving a household ban.
   
   Also, you are NOT to share information with other household members. We can clearly see when two different players get served the same questions, so using one account to read questions/answers and a different account to score 100% on everything is ill-advised.

Thank you for following these simple rules.

(21) GENERAL CONTEST RULES 

1. SPONSOR AND ADMINISTRATION
   All trivia contests (each, a "Contest") are sponsored and administered by either sparc or a Partner Site.  Unless otherwise explicitly disclosed, no Contest is in any way sponsored, endorsed, or administered by, or associated with, any third-party media platform on which it may appear. Sparc licenses its quiz software to Partner Sites, who may use the quiz software to administer a Contest in accordance with these Official Rules.

2. ELIGIBILITY
   The Contest is open to legal residents of Canada (including Quebec) and the United States who have reached the age of majority in their respective province, territory, or state of residence at the time of entry. Employees, officers, directors, agents, and representatives of sparc or any Partner Site, as well as members of their immediate families and those with whom they reside, are not eligible to participate.

3. NO PURCHASE NECESSARY
   No purchase, payment, or other consideration is required to enter or win any Contest. Entry into a Contest is contingent solely upon participation in the designated trivia segment during the applicable broadcast.

4. METHOD OF ENTRY
   To participate, entrants must access the designated trivia segment during the applicable broadcast and submit their answers through the approved contest platform within the allotted timeframe. Late or incomplete submissions will not be considered. Any attempt to tamper with or manipulate the contest process may result in disqualification in the sole discretion of spar or a Partner Site.

5. WINNER DETERMINATION AND NOTIFICATION
   The winner of a Contest shall be determined based on the highest score which is based on answering questions correctly and in a short amount of time. In the event of a tie, a skill-based tiebreaker—such as an additional trivia question, a timed challenge, or another skill-based mechanism—will be employed to determine the winner. The specific nature of the tiebreaker shall be determined in the sole discretion of sparc or the Partner Site. Winners will be notified through the Services or Software, or email or direct message within five [5] business days of the conclusion of the Contest.

6. PRIZES
   The winner shall receive a prize valued at no more than $500 CAD. Prizes are non-transferable, non-exchangeable, and must be accepted as awarded. Sparc or the Partner Site reserves the right, in its respective sole discretion, to substitute any prize with another of equal or greater value where necessary due to circumstances beyond its reasonable control.  All prize recipients are solely responsible for reporting and paying any applicable federal, state, provincial, and local taxes associated with the receipt of a prize. Neither Sparc nor its Partner Sites provides any tax advice.  Sparc recommends that winners consult with a qualified tax professional regarding their obligations. Sparc or a Partner Site may issue tax forms (such as IRS Form 1099-MISC for U.S. residents) where required by law.

7. GENERAL CONDITIONS
   By participating, entrants agree to comply with the entirety of this Agreement as well as these General Contest Rules (Agreement Section 22) and to be bound by the decisions of sparc or a Partner Site, which shall be final and binding in all matters relating to any Contest. sparc or a Partner Site reserves the right to modify, suspend, or terminate a Contest at any time due to technical issues, fraud, or any other factors that may compromise the integrity of the Contest. Participation in any Contest is also subject to compliance with this Agreement, sparc’s Privacy Policy, and other obligations disclosed by Partner Site’s.

8. RELEASE OF LIABILITY
   By entering any Contest, participants release and hold harmless sparc or a Partner Site, and the respective affiliates, subsidiaries, advertising and promotional agencies of each, and the respective officers, directors, employees, and agents of all the foregoing from any and all liability arising from or in connection with participation in the Contest or acceptance, use, or misuse of any prize awarded.

9. QUEBEC-SPECIFIC COMPLIANCE
   For residents of Quebec, this Contest is subject to the provisions of the Act respecting lotteries, publicity contests, and amusement machines and is regulated by the Régie des alcools, des courses et des jeux. Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie for a ruling.

10. U.S. COMPLIANCE AND VOID WHERE PROHIBITED
    This Contest complies with applicable U.S. federal and state laws. Participation in the Contest is void where prohibited by law.

11. GOVERNING LAW
    This Agreement and any Contest shall be governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada, as well as the laws of any relevant U.S. jurisdiction, without regard to conflict of law principles.

(22) HOCKEY BRACKET CHALLENGE RULES

From time to time, sparc may offer a seasonal "Hockey Bracket Challenge" (the “Bracket Challenge”) that allows users to predict the outcomes of professional hockey playoff series. Participation in the Bracket Challenge is subject to this Agreement, sparc’s Privacy Policy, and all General Contest Rules (Section 22).

Participation is free and open to eligible users. A valid sparc account is required to enter.

Entrants will submit completed brackets predicting the winners of each round in a professional hockey postseason. Points will be awarded based on accuracy of predictions, including bonus points for correctly identifying the number of games in a series or answering designated tiebreaker questions.

All bracket submissions must be completed and submitted before the closing time listed on the event page. After that time, all brackets are locked and may not be edited or resubmitted.

The Bracket Challenge is skill-based. In the event of a tie, sparc may employ a tiebreaker mechanism based on skill — such as an additional trivia question or a time-based bonus — to break any tie and to determine a winner. The specific method and timing of any tiebreaker will be determined at the sole discretion of sparc or a Partner Site.

By participating, you consent to your username, bracket title, and score being displayed on a publicly visible leaderboard, if applicable.

Prizes (if any) will be disclosed on the Bracket Challenge landing page. All prizes will comply with sparc’s prize value limits and eligibility requirements as stated in Section 21.

The Bracket Challenge is for entertainment purposes only. It is not affiliated with, sponsored by, or endorsed by the National Hockey League or its teams. All NHL-related marks are the property of the NHL and are used for descriptive purposes only.

sparc reserves the right to reject or disqualify any entry that contains a username, bracket title, or other participant-generated content deemed offensive, misleading, or in violation of third-party rights.

sparc may revise the Bracket Challenge rules, structure, or scoring methodology at any time upon notice to participants via the contest landing page.

sparc reserves the right to cancel, suspend, or modify the Bracket Challenge in part or in whole due to circumstances beyond its reasonable control, including but not limited to force majeure events such as natural disasters, public health emergencies, technical failures, or disruptions to the referenced playoff format.

Any attempt to tamper with, manipulate, or otherwise interfere with the integrity of the Bracket Challenge may result in disqualification and account suspension in accordance with Section 20 (Cheating).

(22A) HOCKEY BRACKET CHALLENGE RULES PRIVACY & DATA USE NOTICE

By participating in any Bracket Challenge hosted by sparc or a Partner Site, you acknowledge and agree to the collection and limited use of your bracket-related information. This includes your submitted picks, username, bracket title, scoring data, and any tiebreaker responses (if applicable).

Your username and score may be displayed on public leaderboards associated with the Bracket Challenge. Aside from leaderboard visibility, sparc does not share or sell bracket data to third parties and does not use bracket submissions for targeted advertising.

sparc processes bracket-related data solely for the purpose of administering and publicizing the contest, verifying entries, resolving ties, communicating results, and awarding prizes. Your participation in the Bracket Challenge constitutes consent to such data use, which is subject to sparc’s Privacy Policy.
